Terms of Service

Welcome to Bay24 Indoor Golf ("Bay24," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Bay24 mobile application (the "App"), the website at bay-24.com (the "Website"), and all related services (collectively, the "Services").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Account Registration & Eligibility

• You must be at least 18 years of age to create an account and use our Services.
• You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You may not create multiple accounts, share your account with others, or transfer your account to another person without our prior written consent.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

2. Booking Policies

2.1 Reservations

• Bay reservations are subject to availability at each Bay24 venue.
• You may book bays through the App, Website, or at a venue kiosk.
• All bookings require valid payment at the time of reservation.

2.2 Cancellations

• You may cancel a booking up to 2 hours before the scheduled start time for a full refund.
• Cancellations made less than 2 hours before the scheduled start time are non-refundable.
• Bay24 reserves the right to modify cancellation policies at individual venue locations. Any location-specific policies will be displayed at the time of booking.

2.3 No-Shows

• If you do not arrive within 15 minutes of your scheduled start time, your reservation may be forfeited without refund.
• Repeated no-shows may result in restrictions on your ability to make future bookings.

2.4 Buffer Periods

• A buffer period is included between booking slots for bay preparation and cleaning. Please vacate your bay promptly at the end of your reserved time.

3. Food & Beverage Ordering

• Food and beverage items are available for order through the App at participating Bay24 venues.
• Menu availability, pricing, and offerings may vary by location and are subject to change without notice.
• All prices displayed are in U.S. dollars and are inclusive of applicable taxes unless otherwise noted.
• Allergies & Dietary Restrictions: While we make reasonable efforts to provide accurate ingredient information, we cannot guarantee that any menu item is free from allergens. You are responsible for informing venue staff of any allergies or dietary restrictions. Bay24 is not liable for allergic reactions or adverse health effects resulting from food or beverage consumption.
• Orders placed through the App are final once submitted to the kitchen. Refunds for food & beverage items are handled at the venue operator's discretion.

4. Payment Terms

4.1 Payment Processing

• All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's Terms of Service.
• You authorize Bay24 to charge your selected payment method for all applicable fees, including bay bookings, food & beverage orders, membership subscriptions, and any other charges incurred through the Services.

4.2 Refund Policy

• Booking cancellation refunds are governed by Section 2.2 above.
• Refunds for service disruptions (e.g., equipment malfunction) will be handled on a case-by-case basis. Please contact support@bay-24.com or speak with venue staff.
• Refunds, when approved, are processed to the original payment method and may take 5–10 business days to appear on your statement.

5. Membership Plans

• Bay24 offers optional membership plans with recurring billing. Membership details, benefits, and pricing are described on the Membership page.
• Recurring Billing: By subscribing to a membership, you authorize Bay24 to charge your payment method on a recurring basis (monthly or annually, as selected) until you cancel.
• Cancellation: You may cancel your membership at any time through the App or by contacting support@bay-24.com. Cancellation takes effect at the end of your current billing period; no prorated refunds will be issued for partial periods.
• Price Changes: We may change membership pricing with at least 30 days' advance notice. Continued use of the membership after the price change constitutes acceptance of the new pricing.

6. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to our systems, other users' accounts, or any restricted portions of the Services.
• Use automated tools, bots, scrapers, or scripts to access or interact with the Services.
• Send spam, unsolicited messages, or promotional content through the Services.
• Interfere with or disrupt the integrity or performance of the Services.
• Harass, abuse, or harm other users, venue staff, or Bay24 employees.
• Misrepresent your identity or affiliation with any person or organization.
• Resell, redistribute, or sublicense access to the Services or any bay booking.

7. Intellectual Property

• All content, features, and functionality of the Services — including but not limited to the Bay24 name, logo, BayOS platform, software, text, graphics, images, and design — are the exclusive property of Bay24 or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse-engineer or attempt to extract the source code of our software.
• We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• Bay24 and its officers, directors, employees, agents, franchise operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
• Our total aggregate liability for any claim arising from or relating to these Terms or the Services shall not exceed the amount you have paid to Bay24 in the 12 months preceding the event giving rise to the claim.
• Bay24 is not responsible for any injury, property damage, or loss that occurs at a Bay24 venue. Use of simulator equipment is at your own risk.
• The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bay24, its officers, directors, employees, agents, and franchise operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

• You may terminate your account at any time by contacting us at support@bay-24.com or through the account deletion feature in the App.
• We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if your use poses a risk to Bay24 or other users.
• Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will survive.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration or litigation as described below.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States of America, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Rock County, Wisconsin, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our Website and App, and by updating the "Effective Date" at the top of this page. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bay24 regarding your use of the Services and supersede all prior agreements and understandings.
